On July 1, 2022 WIPO changed the Sequence Listing format from ST.25 format to ST.26 format, essentially meaning that Sequence Listings now need to be filed in eXtensible mark-up language, better known as XML.
With the adoption of ST.26 as the new standard for sequence listings, the MXPTO revised its regulations on July 4, 2022 as outlined:
- If the international filing date of the international application is prior to July 1, 2022 (for PCT applications) or if the claimed priority was filed prior to July 1, 2022 (for direct applications - i.e. Paris Convention applications), then the Sequence Listing should be filed in ST.25 format.
- If the international filing date of the international application was on or after July 1, 2022 (for PCT applications) or if the claimed priority was filed on or after July 1, 2022 (for direct applications - i.e. Paris Convention applications), then the Sequence Listing should be filed in ST.26 format. Likewise, if the application is a direct application which does not claim a priority, however was filed on or after July 1, 2022, then the Sequence Listing should be in ST.26 format.
